Defendant, Jihad Abuznaid, by and through his undersigned counsel sues third party defendant, Restoration Woeship Center as follow:
The allegations of plaintiff are that the Church is causing a noise nuisance and disrupting the business of the plaintif, a co-tenant d/b/a ANUTTURA YOGA in the shopping center who alleges that the church is causing a noise nuisance when singing, praying,and playing music during its sundays, Wednesdays and Fridays services. The Anuttura Yoga people allege that the noise nuisance by the Church has caused annoyance, discomfort, inconvenience, sickness, irritability, emotional stress, disturbance and the free use, possession, and enjoyment of Plaintiff's, rendering its ordinary use and occupation physically uncomfortable. They also claim that because of the noise generating by the church they cannot reach their highest level of meditation when we are there worshiping our Lord. The Anuttura Yoga people state the Defendants knew or should have known that the Church would routinely and continuously disrupt the quiet enjoyment of plaintiff's leased space because it is in the same business as the previous church.

In the event that Plaintiff recovers a judgment against Abuznaid, then Abuznaid is entiled to indemnity from the Church for the total of the judgment recovered.
Abuznaid has retained counsel to defend the action brought by Plaintiff and has incurred and will continue to incur attorney's fees, cost and expenses in defense of this action.
Church is obligated to pay attorney's fees, costs and expenses incident to Abuznaid's defense in this action.
Wherefore, Abuznaid demands judgment against third party Defendant, Restoration Worship Center, for indenmnification, including cost and attorney's fees and any further relief that this Court deems just and proper.

This is the first time in my ministry that I am facing such a challenge. The church is a very young church(3 years old) that the Lord is using in a magnificent way to impact and transform the lives of the young people in the community. We have seen trenmendous growth in the church since we launched a three years ministry plan of evangelization on January 2011 to reach the whole community of Deerfield Beach but targetting young college people especially; the devil has been using the Yoga people to stop us from fulfilling the Great Commission.

Hi Duvard. I contacted Church Ministries here at the National Office and John Soper has gotten involved. He has notified your church district of this situation and they will handle it from here. Your District Superintendent is your greatest resource in this matter. I will certainly be in prayer for this to be resolved!

Thanks Marvin!Keep us in prayer because the Yoga people who sued The Landlord Jihad Abuznaid whose in return sued the Church, both have big time lawyers representing them in Court against us. The Church is in prayer and we already submitted our case before God. We are waiting on Him to intervene!!!

Keep Restoration Worship Center C&MA in on your prayers because we are a facing a very difficult time. The Church is being sued on the 17th Circuit Court of Broward County because there is a yoga studio in the same building wher we are in and they allerged that the church is disturbing their peace during our worship service. They claimed that they could not reach their highest level of meditation because we are making noise when singing and praying. The Yoga studio sued the landlord because they claimed because of us they lost at least $90,000.00 from their business and they are seeking $200,000.00 to 300,000.00 for damages and attorney fees; and then, the landlord sued the church to make us reliable to pay for the damages in case they lost the case.

A Mediation Hearing is scheduled for May 27, 2011 at 11:00 am this month. The attorney that the Southeastern District assigned to defend the church was told by the District to propose that the church will
be willing to vacate the building within 30 to 60 days if the Yoga Studio agreed to drop the case. If this happens, I really do not know at this point of time, if the church will survive, unless the District does something quickly to provide an alternative within the 60 days window.

During this difficult time, God has been at work in Restoration because we found a building close to the church for sale and the owner is willing to sell it to the church below the market price and we called the city of Deerfield Beach about the building if it suited for church and they told us "YES".

The problem for us now is to raise at least $90,000.00 which is the 20% of the loan to give for deposit. We had already people from the church pledged $10,000.00 donation toward the $90,000.00. This is our situation now and we are praising the Lord that in such time, He will send some generous people not only to pray for us but also to help us in any ways they could.
Praise to the Lord and to Him all the glory!
